The Basque Government welcomes what has happened with concern and surprise, considering it to be a decision that calls into question the very framework for the normalization of the Basque Country in the public administration.
The TSJPV has sent a question to the Constitutional Court on the legality of the Basque Public Employment Act.
The High Court of Justice must rule on the two appeals filed by the PP and Vox to the decree on the normalization of the Basque Country, but before replying, it has asked the Constitutional Court for its opinion.
In particular, it is Article 187.5 which calls into question the need to define a linguistic profile in all public service posts.
Ibone Bengoetxea , who is also First Vice-President of the Basque Government and Counsellor for Culture and Linguistic Policy, welcomes with concern and surprise what has happened, stating that the path taken by the High Court of Justice of the Basque Country is unusual and that it calls into question the very framework for the normalization of the Basque Country in the public administration.
After recalling that there have been many judgments against linguistic profiles, Bengoetxea has stressed that what has happened now is a 'serious leap', precisely because the question of whether or not the Basque Public Employment Act is in accordance with the Constitution has been raised.
For this reason, the Government has submitted allegations to the claim of the High Court of Justice of the Basque Country that the said law is "constitutional".
