An Israeli Army sergeant on duty in Spain has been indicted in the National High Court on charges of war crimes in Gaza
The complaint has been filed by a Palestinian journalist based in Spain, after finding that the sergeant had travelled to Madrid this weekend to watch a football game, showing on his social media accounts what he had done in the Gaza Strip, even though he was currently in Madrid.
Israeli military officer Shaul Shcherbatov wasindicted this Saturday in the National High Courtby a journalist of Palestinian origin for " crimes against persons and property, crimes against humanity and crimes of genocide in an armed conflict, "according to Publico, El País and La Sexta.
The accuser is Gazatí journalist Alhaj Arafat , who has been living in Spain since 2020 with international support.
Arafat has explained that the Israeli officer's trail has been following his Instagram account . From October 2023 to May 2025, he has been explaining in his profile what he had done in the Gaza Strip and recently explained that he was in Madrid with the news of the hotel and that he had gone to watch the Real Madrid-Athletico match in Madrid.
The sergeant has withheld photos posted on his Instagram account of Arafat's alleged involvement in the genocide against the Gazatis.
One of the plaintiff's lawyers has stated that the court should order the arrest of the military "in order to take a statement at least to ensure that the alleged facts are of use to the International Criminal Court".
However, the Public Prosecutor's Office of the National High Court has twice previously refused to admit proceedings against the Israeli military in Spanish territory on the grounds that the International Criminal Court is competent to examine and prosecute such evidence.
